Welcome to the website of Junction Health Inc ("Junction Health," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website at https://www.junction-health.com (the "Site") and our text messaging program described in Section 9. By accessing or using the Site, or by participating in our text messaging program, you agree to these Terms. If you do not agree, please do not use the Site or the program.

1. Informational Purposes Only — Not Medical Advice

The content on this Site is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Nothing on the Site creates a provider-patient relationship. 2. Eligibility

The Site is intended for users located in the United States. By using the Site, you represent that you are at least 18 years old, or that you are using the Site under the supervision of a parent or legal guardian.

You agree to use the Site only for lawful purposes. You agree not to:

  • use the Site in any way that violates any applicable law or regulation;

  • attempt to gain unauthorized access to the Site, its servers, or any connected systems;

TO THE FULLEST EXTENT PERMITTED BY LAW, JUNCTION HEALTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR THE TEXT MESSAGING PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify and hold harmless Junction Health and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or your violation of these Terms.

9. Text Messaging (SMS/MMS) Program

This Section governs your participation in our text messaging program (the "Program"). By opting in or by sending a text message to us, you agree to the terms in this Section.

Program description. The Program allows Junction Health to send and exchange text messages (SMS/MMS) for administrative and coordination purposes, including communications between our team, such as our provider relationship managers, and referring providers and their staff regarding scheduling, logistics, status updates, and related account or service notifications. The Program is not intended for the exchange of protected health information (PHI); please do not send sensitive health details by text.

Consent and opt-in. By providing your mobile phone number and opting in, you consent to receive text messages from Junction Health at the number provided, including messages sent using automated technology. Consent to receive text messages is not a condition of receiving any service from us. You represent that you are the account holder or an authorized user of the mobile number you provide and that you are at least 18 years old.

Message frequency. Message frequency varies based on your interactions with us.

Cost. Message and data rates may apply according to the plan you have with your wireless carrier. Junction Health does not charge for the Program, but your carrier's standard rates apply, and you are responsible for any such charges.

Opting out. You can cancel the Program at any time by replying STOP to any message you receive from us. After you reply STOP, we will send a one-time confirmation message and will not send you any further Program messages unless you opt in again. You may also contact us using the information in Section 12 to opt out.

Carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed.

Privacy. Information collected through the Program is handled in accordance with our Privacy Policy at https://www.junction-health.com/privacy-policy. We do not sell your personal information, and we do not share your mobile phone number or text messaging consent with third parties for their marketing purposes.

10. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado, unless otherwise required by applicable law.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the current version on this page. Your continued use of the Site or the text messaging program after an update means you accept the revised Terms.
